These Terms govern your access to and use of Bitmaker Cloud — the managed hosting service for the Estela spider orchestration platform.
These Terms and Conditions ("Terms") govern your access to and use of Bitmaker Cloud ("BMC", the "Service"), a managed web-scraping platform operated by Bitmaker E.I.R.L., a company incorporated in Peru with offices in Arequipa ("Bitmaker", "we", "us", "our").
By creating an account, accessing the Service, or clicking a button indicating acceptance, you ("you", "Customer") agree to be bound by these Terms. If you are accepting on behalf of a company or other legal entity, you represent that you have authority to bind that entity.
These Terms incorporate by reference our Privacy Policy and Acceptable Use Policy. In case of conflict, these Terms control unless an incorporated document expressly states otherwise.
You may create an Account only if:
You agree to provide accurate, current, and complete information when creating your Account and to keep it updated. You are responsible for safeguarding your credentials and for all activity that occurs under your Account.
You may not create more than one personal Account, share credentials with third parties, or register on behalf of another person without authorization. Organizations may create a single team Account with multiple authorized members.
Features identified as "beta", "preview", or "experimental" are provided AS-IS, are not covered by any service-level commitment, and may be modified or removed at any time without notice. Do not rely on beta features for production workloads.
You must use the Service in compliance with all applicable laws and our Acceptable Use Policy.
The following are strictly prohibited. Violation may result in immediate suspension or termination of your account:
We may investigate suspected violations and, in our reasonable judgment, suspend or terminate access without prior notice where the breach is not curable or poses an immediate risk.
You are solely responsible for determining whether your use of the Service is lawful. The Service is a general-purpose execution platform; we do not pre-screen Target Sites. Specifically, you are responsible for:
You may only use the Service to collect data from sources accessible without authentication, or from sources for which you have explicit authorization. You may not use the Service to access content protected by login or paywall without such authorization.
If we receive a credible complaint from a Target Site (including a cease-and-desist letter, DMCA notice, or data-protection authority order), we may suspend further scraping of that Target Site while we investigate. We will notify you and give you an opportunity to respond.
BMC is priced on a credit-consumption basis. Prices are published at estela.dev/pricing.

Credits are consumed by spider execution, storage, requests, and other resource usage as described in the Documentation. Credits do not roll over between billing periods unless expressly stated for your plan. Unused credits expire as described at estela.dev/pricing.
If a charge to your payment method fails, we will retry over several days and send you a written warning. Running jobs finish — we never kill a job mid-crawl because a credit balance reached zero. Your data, projects, and configuration remain intact. Execution resumes automatically once the balance is topped up. If payment is not received after the retry window, we may suspend the Service until outstanding amounts are paid.
If you dispute a charge in good faith, notify billing@bitmaker.la within 15 days of the invoice date with reasonable detail. Charges not disputed within that window are deemed accepted.
We may change prices from time to time. Price changes apply prospectively only, beginning with your next billing period. We will give at least 30 days' notice of any price increase by email and through the dashboard. If you do not accept the new pricing, you may cancel before it takes effect.
Prices are exclusive of taxes. You are responsible for all applicable sales, use, value-added, withholding, and similar taxes, except taxes imposed on Bitmaker's net income.
You retain all right, title, and interest in your Customer Data, including your Spiders and Scraped Data. You grant Bitmaker a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display Customer Data solely to provide and improve the Service.
The Estela spider orchestration platform is MIT-licensed and available at github.com/bitmakerla/estela. BMC is the managed hosting layer built on top of that open-source foundation. Your use of BMC does not restrict your rights under the MIT License.
The BMC platform, dashboard, and related proprietary tooling are owned by Bitmaker or its licensors. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes during the term of these Terms.
We do not use Customer Data (including Scraped Data or your spider source code) to train machine-learning models for Bitmaker's general products without your prior express consent.
If you provide suggestions or feedback about the Service, you grant us a perpetual, irrevocable, royalty-free license to use it for any purpose, without obligation or compensation.
Our processing of personal data is described in the Privacy Policy. Customer Data processed through BMC is stored in data centers in Falkenstein, Germany (European Economic Area), operated by Hetzner Online GmbH.
Where you use the Service to process personal data subject to GDPR, CCPA, Peru's Law 29733, or another applicable data-protection law, you act as the controller of that data and instruct Bitmaker to process it solely to provide the Service. You represent that you have a lawful basis to upload or generate any personal data in Customer Data.
You may terminate your Account at any time by following the closure procedure in the dashboard or by emailing support@bitmaker.la. Termination is effective at the end of the current billing period unless you request earlier termination.
We may suspend or terminate your access immediately on notice if:
On termination, your right to access the Service ends. You may export Customer Data for 30 days after the effective date of termination using the export functions in the dashboard. After that 30-day window, we may permanently delete Customer Data. All amounts owed for the period before termination remain due.
Except as expressly stated in these Terms, the Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind. Bitmaker specifically disclaims all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Without limiting the foregoing, Bitmaker does not warrant that:
The Service is provided on a best-effort basis for self-service plans. For enterprise-grade uptime guarantees and SLA-backed incident response, see Estela Commercial Support.
To the maximum extent permitted by law, Bitmaker will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, revenue, goodwill, or data — arising out of or related to these Terms or your use of the Service.
Bitmaker's total cumulative liability arising out of or related to these Terms will be limited to the extent permitted by applicable law. The specific liability cap applicable to your engagement will be set forth in your account agreement or, where no specific cap is agreed, will reflect a reasonable proportion of the fees paid by you for the Service in the period preceding the event giving rise to the claim.
Nothing in this section limits liability for fraud, gross negligence, willful misconduct, or personal injury caused by negligence.
These Terms are governed by the laws of Peru. Any dispute arising out of or related to these Terms that cannot be resolved by direct negotiation shall be submitted to the courts of Arequipa, Peru.
Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
These Terms, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Bitmaker about the Service and supersede any prior agreement on the same subject.
We may modify these Terms from time to time. We will provide notice of material changes at least 30 days before they take effect by email and by posting an updated version at estela.dev/bmc-terms. Your continued use of the Service after the effective date constitutes acceptance.
If any provision is held unenforceable, the remaining provisions remain in effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of substantially all of our assets. Any prohibited assignment is void.
Neither party is liable for failure to perform (other than payment obligations) due to events beyond its reasonable control, including acts of God, war, civil unrest, internet or utility failures, or government action.
